What Do You Need to File for Bankruptcy?

What Documents Do You Need to Bring to Your Bankruptcy Consultation?
For our attorneys to gauge your needs and determine if you qualify for bankruptcy, and to make sure your bankruptcy is handled effectively, we will need you to provide us with the following documents at your bankruptcy consultation:
- Tax returns or proof of income for the past three years
- Pay stubs for the past six months or other proof of income for the same period
- If self-employed, your year-to-date profit and loss statement and balance sheet
- Proof of other income such as child support and rental income
- Recent statements from each of your creditors, such as credit cards
- Statements from each deposit account, such as checking and savings, for the past two months
- A recent statement from all retirement accounts, including 401K and IRA accounts
- All outstanding loan documents, including home mortgages, automobiles, RVs and boats
- Your property tax statement
- Copies of any collection notices, wage garnishment orders, pending lawsuits, judgments, or default notices from attorneys, creditors or collection agencies
- Information pertaining to any prior bankruptcy, including case number, year filed, type of bankruptcy, location of filing and disposition of the case.
Prior to Filing Bankruptcy
Before we can file your bankruptcy petition, you will need to complete a course in credit counseling and provide us with a Certificate of Completion of Credit Counseling. This course can be completed online through an approved provider. Visit our Resources page for a list of credit counseling agencies approved by the U.S. Department of Justice
Also, you will need to provide us with a copy of your credit report, as well as keep us updated with current pay stubs and income information up to the date of your bankruptcy filing.
After Filing Bankruptcy
As you embark on your life after bankruptcy, you will need to complete a course in financial management from an approved credit counseling agency and provide the court with a signed Statement of Completion before you can receive a discharge of debts.
